A federal judge ruled Friday that the federal government’s decision to require a generic version of the blockbuster drug Viagra to a different brand in the US is unreasonable. The decision is likely to be the final ruling for the United States District Court for the District of Columbia, after which the Food and Drug Administration will determine whether to issue the required generic form of Viagra for use under the Food and Drug Administration’s new Generic Medicines List, which expires in the summer of 2017.
In its ruling, Judge Kenneth D. McGinniss of the U. S. District Court for the District of Columbia concluded that the generic version of Pfizer’s drug, Pfizer’s Viagra, can be sold without the generic’s approval. The FDA said that the drug is bioequivalent to Viagra, and Viagra’s manufacturer, Eli Lilly, had argued that the drug is bioequivalent to the generic, meaning it should not be sold without approval. The FDA did not say whether the generic version would be sold by the agency, but did say that the generic would be approved before Viagra’s expiration date. Pfizer did not respond to a request for comment.
A spokeswoman for Pfizer said: “Pfizer’s Viagra is bioequivalent to its generic Viagra. It’s the same drug and the same effects as Viagra and similar generics.
“The generic Viagra is a much better choice for the marketplace than Viagra and similar generics. The generic version of Viagra is just as good as the generic and will be more effective than the brand name product.”
The ruling comes just three weeks after a federal appeals court in Connecticut, in which the government argued that the generic version of Viagra was not bioequivalent to the drug and had not been shown to have the same benefit. That ruling was later upheld by the FDA.
Viagra has been the most frequently prescribed drug in the United States since the introduction of the drug in 1998, according to the Food and Drug Administration. In 2003, Viagra was the second-most-prescribed drug in the US. That drug, marketed as Viagra for male impotence, was approved for use in men only.
The first generic to receive approval was Pfizer’s Cialis in 2003. It had sales of $6.7 billion last year, up 20 percent from the previous year. But its sales plummeted after the patent on Cialis expired in June 2016.
The FDA decision came on the heels of a major study by an Indian group that showed that Viagra’s price among men in the US increased by more than 10 percent from a year earlier.
Viagra’s maker, Eli Lilly, said it was disappointed with the findings of the study, but did not elaborate on the results. “The drug has been shown to be effective,” Eli Lilly, the maker of Viagra, said in a statement.
In a statement, the company said that it was “committed to reviewing the data and developing strategies to ensure that the product is appropriate for the patient population and to support the regulatory process.”
The company also said it was “reviewing its existing marketing and advertising materials to ensure that the drug is appropriate and safe for patients.”
“Our mission is to make the drug more accessible to the American people,” Eli Lilly said in a statement. “We have a responsibility to provide the best possible treatment for our patients.”
Lilly, which has not commented on the ruling, has filed its appeal with the FDA. In June 2017, it voluntarily dismissed the appeal.
A spokeswoman for the FDA said that it was “concerned” that a generic version of Viagra — which Pfizer has been trying to sell since 1998 — could have side effects similar to those of the brand-name drug.
“The FDA has concluded that Viagra’s approval process is not appropriate,” the spokeswoman said in an email.
She said that the FDA had not approved a generic version of Viagra, and that there was insufficient evidence that the drug would be bioequivalent to Viagra. “This decision is an important step in the process,” she added.
The FDA said that the generic version of Viagra, which the FDA has already approved for use under the brand name, was approved for use in men only.
